Eligibility and your account

• You must be at least 18 years old and able to enter into a binding contract under Indian law.
• If you use the Platform on behalf of a business, you confirm that you are authorised to accept these Terms for that business.
• You log in with your mobile number and a one-time password (OTP). You are responsible for keeping access to that number secure and for all activity on your account.
• The information you provide, including your name and business details, must be accurate and kept up to date.
• Tell us immediately if you suspect unauthorised use of your account.

What the Platform does

Bodhiyo helps employers post jobs, discover candidates, receive AI-based candidate recommendations and communicate with candidates directly.

Bodhiyo is a technology platform that connects employers and candidates. We are not a recruitment agency or a party to any employment relationship, and we do not guarantee that you will find a candidate or that a candidate will accept an offer.

Job posts

When you post a job, you agree that:

• the job is real, currently open and described accurately, including the role, pay, location and working conditions;
• the job complies with applicable laws, including laws on minimum wages, working conditions and equal opportunity;
• you will not discriminate against candidates on the basis of religion, caste, gender, disability or any other ground prohibited by law;
• you will not charge candidates any fee for applying, interviewing, training or getting hired; and
• you will not post jobs that are misleading, illegal, pyramid or multi-level marketing schemes, or that ask candidates for money or sensitive financial details.

We may review, edit, pause or remove any job post that we believe breaks these Terms, without notice.

Using candidate information

Candidate profiles and messages are shared with you only so you can hire for your own open positions. You agree to:

• use candidate information only for genuine recruitment for your business;
• not copy, download in bulk, sell, share or publish candidate information, or use it for marketing;
• not contact candidates for any purpose other than the jobs you are hiring for; and
• keep candidate information secure and delete it when you no longer need it for hiring.

You are responsible for complying with data protection laws, including the Digital Personal Data Protection Act, 2023, for any candidate information you receive through the Platform.

Acceptable use

You must not:

• harass, threaten, abuse or send spam to candidates or other users;
• impersonate any person or business, or misrepresent your affiliation;
• use bots, scrapers or other automated means to access or copy data from the Platform;
• try to gain unauthorised access to the Platform, its systems or other users' accounts;
• interfere with the security or proper working of the Platform; or
• use the Platform for anything illegal or fraudulent.

AI recommendations

Candidate recommendations are generated automatically from the information in your job posts and candidate profiles. They are provided to help you and may not always be complete or accurate.

You are solely responsible for your hiring decisions, including checking candidate details, qualifications and references before hiring.

Plans, pricing and payments

• Some features are available on paid plans. Each plan has a validity period and usage allowances, such as active job posts, candidate conversations and candidate discoveries, as shown on the plans page at the time of purchase.
• Prices are shown in Indian Rupees and include GST unless stated otherwise. A GST invoice is issued for every successful payment and is available in your Payment history.
• Payments are processed securely by our payment partner, Razorpay. We do not store your card, UPI or bank details.
• A plan becomes active as soon as your payment is confirmed. Allowances apply only for the plan's validity period. Unused allowances do not carry over when a plan expires or is replaced.
• You can upgrade to a higher plan at any time. The new plan starts immediately with its own validity period and allowances.
• Downgrading to a lower plan is not available while your current plan is active. You can choose any plan after it expires.
• When a plan expires, features that need that plan stop until you renew or buy a new plan.
• We may change plans, prices or allowances in the future. Changes will not affect a plan you have already paid for during its validity period.

Cancellations and refunds

Plans are prepaid for their validity period and give you immediate access to paid features, so payments are non-refundable and plans cannot be cancelled part-way for a refund, except where required by law.

If you were charged in error, for example charged twice for the same order or charged without a plan being activated, contact us at bodhiyo@heuristech.io within 7 days of the payment with your payment ID. Once confirmed, we will refund the amount to your original payment method, usually within 5 to 7 working days.

Intellectual property

The Platform, including its software, design, logos and the Bodhiyo name, belongs to Heuristech Innovation Labs Private Limited and is protected by law. You may not copy, modify or distribute any part of it without our written permission.

You keep ownership of the content you add, such as job posts and your company details. You give us a non-exclusive, royalty-free licence to host, display and process that content only to operate and promote your job posts on the Platform.

Suspension and termination

We may suspend or close your account, remove content or limit access to the Platform if you break these Terms, if we are required to by law, or to protect candidates, other users or the Platform. Where reasonable, we will tell you why.

You may stop using the Platform and ask us to close your account at any time. Closing your account does not entitle you to a refund of any plan already purchased.

Disclaimers

The Platform is provided "as is" and "as available". We work hard to keep it running smoothly but do not promise that it will always be available, uninterrupted or error-free.

We do not verify every candidate or employer and are not responsible for the accuracy of information that users provide, or for the conduct of any user on or off the Platform.

Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential losses, including loss of profits, business or data, arising from your use of the Platform.

Our total liability for any claim relating to the Platform is limited to the amount you paid us in the 3 months before the event that gave rise to the claim.

Indemnity

You agree to compensate and protect us from any claims, losses or expenses, including reasonable legal fees, that arise from your job posts, your use of candidate information, your breach of these Terms or your violation of any law.

Governing law and disputes

These Terms are governed by the laws of India. Any dispute will first be discussed in good faith. If it cannot be resolved, the courts at Pune, Maharashtra will have exclusive jurisdiction.

Changes to these Terms

We may update these Terms from time to time. We will change the "Last updated" date on this page and, for significant changes, notify you on the Platform. Continuing to use the Platform after an update means you accept the updated Terms.
